What is spousal support?
Spousal support is monetary support paid from one spouse (or former spouse) to the other. In the context of divorces and dissolutions, one party may be ordered to make payments to the other.
Does every divorce/dissolution include a spousal support order?
No, not every divorce/dissolution includes a spousal support order. Many factors, which are found in ORC 3105.18, determine whether spousal support is ordered.
How much spousal support will I pay/receive?
It depends. There is no specific formula for computing spousal support. Rather, courts will consider the factors in ORC 3105.18, and may order payment of spousal support that it finds to be reasonable and appropriate.
How long does spousal support last?
There is no fixed rule. Duration depends on the facts of the case and the factors listed in ORC 3105.18(C).
Can spousal support be modified?
Sometimes. Jurisdiction must be expressly reserved, pursuant to ORC 3105.18(E), for a court to be allowed to modify spousal support.
What if my spouse quits a job?
Courts may consider earning ability under ORC 3105.18(C)(1)(b), even if a spouse isn’t currently employed.
What happens if support is unpaid?
The court may enforce orders through contempt proceedings.
