Who pays child support?
In general, the parent who is not the residential parent and legal custodian of the child will pay child support. This can be complicated in shared parenting situations and in other unique family situations, therefore each case requires a detailed and careful analysis.
How much child support will be paid?
Child support amounts are very fact-specific, and are calculated using a basic child support schedule and a corresponding worksheet, pursuant to ORC Chapter 3119. A child support order will also detail who will be responsible for health care coverage and/or health care expenses.
Is child support based on both incomes?
Yes, under ORC Chapter 3119, the incomes of both parents are part of the calculation. Other factors in the calculation include the out-of-pocket costs for health care and the out-of-pocket costs for daycare.
Can support be modified?
Yes, child support is modifiable under ORC Chapter 3119.
What if a parent is unemployed?
Under some circumstances, income may be imputed.
Does equal parenting eliminate support?
Not necessarily. Child support deviations are highly fact-specific and require a careful analysis.
Can parents agree to a different amount?
Sometimes. Pursuant to ORC 3119.22, Ohio courts must still consider the basic child support schedule, and must find that any deviation is in the best interests of the child.
